Terms & Conditions

Last updated: 24 August 2026

These Terms & Conditions apply to website design, development and related digital services provided by OB Digital Works ("we", "us", "our") to customers ("you", "the client").

By purchasing our services, paying a deposit, approving a project, or instructing us to begin work, you agree to these Terms & Conditions.

1. Our Services

OB Digital Works provides website design, website development and related digital services.

The exact features, pages, functionality, price and estimated timeframe of each project will be agreed with the client before work begins.

Any work requested outside the originally agreed project scope may result in an additional charge.

2. Quotes & Pricing

Prices provided to clients are based on the requirements discussed at the time of quotation.

If the client later requests additional pages, features, integrations, significant design changes or other work outside the original agreement, OB Digital Works may provide a separate quote for that work.

Any ongoing third-party costs, including domain registration, hosting, email services, paid software, APIs or other subscriptions, will be explained where applicable and may be payable separately by the client.

3. Deposits & Payment

OB Digital Works may require a deposit before work begins.

Unless otherwise agreed, any remaining balance must be paid when the project is completed and before the final website, files, accounts or ownership are transferred to the client.

Deposits may be non-refundable once substantial work on the project has begun.

If additional work is requested outside the agreed scope, additional payment may be required.

4. Client Responsibilities

The client is responsible for supplying any information reasonably required to complete the project, including text, photographs, logos, contact information, prices and business information.

The client confirms that they have permission or appropriate rights to use any content supplied to OB Digital Works.

OB Digital Works is not responsible for copyright, trademark or other legal issues arising from content supplied or specifically requested by the client.

Delays in receiving required information or feedback from the client may delay completion of the project.

5. Revisions

Reasonable revisions are included during development unless otherwise agreed.

Major changes to an approved design, repeated changes, new functionality or requests that significantly alter the original project may be treated as additional work and charged separately.

We will inform the client before carrying out work that will incur additional charges.

6. Project Timeframes

Any completion date or timeframe provided is an estimate unless explicitly agreed otherwise in writing.

We will make reasonable efforts to complete projects within the estimated timeframe but cannot guarantee completion by a particular date where delays arise because of client feedback, third-party services, technical problems or circumstances outside our reasonable control.

7. Cancellation

A client may request cancellation of a project at any time.

Where work has already begun, the client may be responsible for payment for work completed up to the cancellation date.

Any deposit already paid may be retained to cover work already completed and time allocated to the project.

8. Website Approval

Before a project is considered complete, the client will have an opportunity to review the website and request reasonable corrections.

Once the client approves the completed website, responsibility for checking business information, prices, contact details, spelling and supplied content rests with the client.

9. Ownership

Once all agreed payments have been received, the client will receive the rights to the final website created specifically for their project, subject to any third-party licences or services used.

OB Digital Works retains ownership of its own reusable tools, methods, templates, components and underlying know-how that were not created exclusively for the client.

Third-party software, fonts, plugins, libraries, images and services remain subject to their respective licences and terms.

10. Portfolio Use

Unless otherwise agreed, OB Digital Works may display completed client projects in its portfolio, website or social media as examples of previous work.

A client may request that confidential or sensitive information is not displayed.

11. Domains, Hosting & Third-Party Services

Where OB Digital Works assists with domains, hosting, email, databases, payment providers or other third-party services, those services may be governed by separate terms and conditions from their respective providers.

OB Digital Works does not control third-party services and cannot guarantee that they will operate without interruption.

Where possible, important business accounts should ultimately be registered in or transferred to the client's control.

12. Maintenance & Updates

Unless an ongoing maintenance agreement has been purchased, the original project price does not include unlimited future updates, redesigns, new features or ongoing maintenance.

Additional work requested after completion may be quoted separately.

13. Website Availability

We take reasonable care when designing and developing websites but cannot guarantee that a website will operate without interruption or error indefinitely.

Hosting outages, software updates, third-party services, browser changes, cyber incidents and other circumstances outside our control may affect website availability or functionality.

14. Liability

OB Digital Works will take reasonable care when providing its services.

To the maximum extent permitted by applicable law, OB Digital Works will not be responsible for indirect or consequential losses arising from circumstances outside our reasonable control, third-party service failures, client-supplied content, or changes made to the website by the client or another party after completion.

Nothing in these Terms & Conditions excludes or limits any rights or liability that cannot legally be excluded under Irish law.

15. Privacy

Personal information collected in connection with enquiries and projects will be handled in accordance with our Privacy Policy and applicable data-protection law.

16. Changes to These Terms

We may update these Terms & Conditions when our services or legal requirements change.

The version applicable to a particular project will generally be the version in effect when the client agrees to proceed, unless otherwise agreed.

17. Governing Law

These Terms & Conditions are governed by the laws of Ireland.

Any disputes will be subject to the jurisdiction of the Irish courts, subject to any mandatory consumer rights that apply.
